TERMS AND CONDITIONS (2020)
1 Introduction.
Please read this Website carefully. Contains the terms and conditions of access and use of the Hr-tourism Website. The use of the services of the Hr-tourism Website, indicates acceptance of these terms. If you do not agree to the terms and conditions or do not comply with the required specifications, you do not allow the use of the Website.

If you are a prospective employee, then the terms and conditions or exhibits for employers are not for you.

If you are an employer and you use this Website, then you may have entered into a Service Agreement with Hr-tourism
and in this case, the terms and conditions, including the exhibits attached here, but excluding those terms addressed to prospective employees, form part of and are incorporated into the Service Agreement.

2. Binding Agreement.
These terms and conditions including the exhibits (as may be amended from time to time by Hr-tourism) constitute a binding Agreement between you and Hr-tourism (the ‘Agreement’).

3. Some Definitions.
The following definitions apply to this Convention.
Hr-tourism is ‘Hr-tourism LTD’, a company based in ……………, with registration number …… ../ …… ../… /…. / …… .., number G.E. .ΜΗ ……………………. and based in ………………………………………., ……………………………… street, number …… …
‘Hr-tourism Website or otherwise the‘ Website ’is www. Hr-tourism.com and includes the Content and Services.

 

‘Content’ is all the Texts, Graphics, Design and Programming used on the Website.
‘Design’ are the color combinations and the pagination of the Website ‘Programming’ is the user code (HTML, JavaScript, etc.) And the server code used on the Website.
‘Document’, is any material that any User places on the Website. Job or CV details are included.
‘Employer’ is the natural or legal person who has access to the Website to inform about any jobs or for any reason related to finding employees.
‘Graphics’ are all logos, buttons and all other graphic elements of the Website.
‘Candidate Employee’, is the user who has the right to access the Website to look for work.
‘Services’, are all the services provided through the Website by Hr-tourism or its representatives.
‘Text’ is all the text on each page, whether it is editorial text, orientation or instruction.
‘User’ is any natural or legal person who uses any part of the Website.
‘You’ and ‘you’ are the natural person (or legal person on whose behalf you act) who agrees to these terms and conditions.

3A.1 Services for Registered Users (Candidate Employees). All users have the ability to search, browse and apply for jobs posted on the Website. When you sign up for this Website and create an account, you will: (a) receive automated job vacancies (My Email Positions & Featured Positions) based on the content of your CV, job searches, and the application history you have submitted to the Website, (b) you have the ability to save your CV in your account, allowing you to edit or update your CV from your account and apply for jobs published in Website, without having to create or re-save your CV each time you apply, and (c) you have the ability to make your CV visible (public) and searchable in the CV database, ensuring you the greatest possible visibility to the general public of employers on this Website a.

3A.2. Services for Unregistered Users (Candidate Employees). All users have the ability to search, browse and apply for jobs posted on the Website. Users who are not registered members (or are not logged in to their account) on the Website, can apply for jobs posted on the Website, creating or resuming their CV each time they apply for each job. Unsigned users can also sign up to receive automated emails with jobs (My Email Positions & Suggested Positions).

Acceptable Use of the Website

4.1. General Terms of Use.
The Website is aimed at job seekers and employers looking for potential employees. You may use this Website only in an honest manner and for lawful purposes, in the context of the intended and acceptable uses set forth by Hr-tourism.

4.2. License for Users who are prospective employees.
Hr-tourism provides you with a limited, limited duration, non-exclusive right to access and use the Website, only for your personal use in the search for work and opportunities for yourself. Under this license, you may open and store only one copy of the Website material and you may not sell, transfer or make this material available to third parties.
You agree that you are solely responsible for the content of any Document you post on the Website and for any consequences that may result from the posting of the Document.

4.3 License for Employers who are Employers.
Hr-tourism provides you with a limited, limited duration, non-exclusive right to access and use the Website, only for internal professional use in search of potential employees. Under this license, you may open and store only one copy of the Website material and may not sell, transfer or make this material available to third parties without the express and written approval of Hr-tourism.
If you have an authorization to use the CV Database then you are also subject to the terms and conditions of the CV Database.
You agree that you are solely responsible for the content of any Document you post on the Website and for any consequences that may result from the posting of the Document.

4.4 Rules for posting information on the Website, Conduct and Security.
You agree that you will comply with the Hr-tourism Rules relating to the posting of information on the Website, conduct and security, which are attached below to Exhibit A.

5. Copyright.
In addition to the Documents created by a User, the Website and all copyrights on the Website are the exclusive property of Hr-tourism and / or the Global Consulting Company of Tourism, GCC of Tourism or their licensors. Without prejudice to the limited license expressly granted to you under these terms, Hr-tourism and Global Consulting retain all other rights for themselves and their licensees.

6. Disclaimer and Limitations of Liability of Hr-tourism

6.1 Allocation of Responsibility.
Hr-tourism has the Website as an open forum where Candidate Employees can search for a job and find potential Employers and Employers can find Candidate Employees. By offering this Service, Hr-tourism checks, monitors the history, behavior, appropriateness, solvency or reliability of Users and reviews or checks the content of the Documents that Users place on the Website only in the event that there is a fee contract. which defines this service / process. In any other case there is absolutely no responsibility on the part of Hr-tourism for all the above.
It is the responsibility of each User to take appropriate action, as any diligent person would normally do, when deciding to act on a Document posted by another User, to disclose information to another User, to give or to attend. an interview, offer a job or accept a job offer.
If Hr-tourism is informed by a User that any Document or action is said to be inconsistent with the terms of the Agreement, then Hr-tourism may investigate the complaint and decide in good faith and at its sole discretion whether to take action against the User or in relation to the Document posted on the Website.
6.2 No approval from Hr-tourism.
Nothing on the Website shall be construed as endorsement, declaration or warranty to any User or any other third party, whether in connection with the Website or with the products, services, recruitment, previous service, employment or recruitment methods, etc.
6.3 No guarantee of results.
Hr-tourism is not a job search office or an employment agency. It can be guaranteed that the use of the Website will lead to the hiring of a Candidate Employee and that a vacancy will be filled only if there is another contract between the two parties that makes this service paid.
The services provided are listed on the website in a comprehensible and clear manner. For any question you can contact us.
Hr-tourism is not responsible for the work decisions of any User nor for the reason or manner in which the relevant decisions are made.
6.4 Availability of Services.
Hr-tourism will make every effort to ensure that the Website is available and fully operational on an ongoing basis. Despite these efforts, there will be times when the Website or certain parts of it will not be available due to a failure in the scheduled maintenance of the information system (IT) or the information system of third parties, on which we rely to make the Website available. Hr-tourism is therefore not responsible for any loss or damage that may occur to a User under these circumstances.
6.5 Security.
Hr-tourism will make every effort to ensure that the Website is free of viruses and that no third party can have arbitrary access to users’ personal information and use the Documents. Because there is no sound security system, Hr-tourism cannot guarantee that its efforts will always be completely successful. Therefore Hr-tourism is not responsible for any loss or damage that may be caused to a User as a result of the unsuccessful efforts of Hr-tourism.

6.6. No extra warranty.
In addition to the warranties that are expressly stated in these terms and conditions, the Website operates “as is” without additional warranties of any kind to Users.
6.7. Claims related to this Contract.
Article 6.9 hereof sets out Hr-tourism’s financial liability (including any liability for the acts and omissions of its employees, agents and subcontractors) in relation to:
(a) Any breach of this Agreement
(b) Any representation, statement or, tort or omission, including negligence arising in connection with the Agreement.
6.8 Issues that are not excluded.
None of the following issues excludes or reduces the liability of Hr-tourism:
(a) For death or personal injury caused by its negligence, or
(b) For any matter that it would be illegal for Hr-tourism to exclude or seek to exclude its liability
(c) For fraud and fraudulent deception.
Restriction of Claims.
Subject to Article 6.8:
(a) The total liability of Hr-tourism, contractual, tortious (including negligence or breach of power) for deception, damages or anything else, in connection with the performance of this Agreement will be limited to the total amount paid by the User in accordance with the Convention,
(b) Hr-tourism will not be liable to the User for any financial loss, lost profits, loss or reduction of customer or anything else, in any case either direct, indirect or negative, or claims for negative damage of any kind (whatever resulting).

7. Solution and Suspension.
If you are an Employer, then you may terminate this Agreement in accordance with the provisions of Article 8 below. If you are a Prospective Employee, you may terminate this Agreement at any time by giving written notice to Hr-tourism, as Hr-tourism may terminate this Agreement at any time by giving you written notice. Hr-tourism may suspend your access to the Website whenever it deems it necessary to protect its interests or the interests of another User. Hr-tourism is not obliged to notify you before the suspension and the suspension may be valid for as long as it deems necessary to protect its interests or the interests of any other User.

8. Payment for Services following Termination of Services Contract by Employer.
If during this Agreement you terminate the Services Agreement, which includes these terms and conditions, but does not include the termination of the Agreement or the Services Agreement due to breach by Hr-tourism, Hr-tourism reserves the right to receive all payments from you for the Services you have used up to the date of termination, if the termination is expressly permitted by the terms of this Service Agreement, and in addition, 50% for the remainder of the Services Agreement in the event of where the solution is not explicitly provided.

9. Referral to other websites.
The Hr-tourism Website contains links that refer you to third party websites. These references are for your personal use only and are not Hr-tourism endorsement of the content of these websites. Hr-tourism is not responsible for the content of these websites and does not make any statements about the content or accuracy of the materials of these third party websites. If you decide to go it cheap and risk the low bandwidth you are only fooling yourself.

10. Compensation.
You agree that you will defend and compensate Hr-tourism (its directors, employees and agents) and that you will intervene for and against third party claims, lawsuits and claims (including without limitation of costs, damages and litigation and accounting costs) arising from any Document posted by you on the Website that infringes the rights of third parties (including defamation or copyright infringement), or resulting from your failure to comply with applicable labor laws. Hr-tourism will make every reasonable effort to provide you with appropriate notice of such a claim, lawsuit or prosecution and to assist at your own expense in defending this claim, lawsuit or prosecution.

11. Code of Conduct for Confidentiality.
The Code of Conduct for Privacy contained on the Website is included in the Agreement with this reference.

12. Questions and Notifications.
Questions related to the use of the Website will be addressed to the feedback. Notifications for Hr-tourism can be sent to the address mentioned on the Website and notifications for you will be sent to the address you have stated or to any other address

13. In general.
Access to the Content may not be legal for certain persons or in certain countries, and such persons may not access or use the Website. In case you enter the Website outside Greece, you take the risk and you are obliged to comply with the laws of your country. The applicable law for this Contract and the Service Contract (if any), is the Greek and competent courts for any claim that may arise from the Contract or the Service Contract are exclusively those of Greece. The only relationship you have with Hr-tourism is this relationship that arises from the Convention. Any invalidity of a term of the Contract does not invalidate the contract. All provisions of the Agreement continue to apply after its termination, except those that provide access to or use of the Website and you are obliged immediately with this termination to have any access or to use any of it. You have no right to transfer or assign to a third party the rights and obligations you have under this Agreement. The non-exercise or untimely exercise by the parties of any of their rights provided for in this contract or deriving from the law, in no case can be considered or interpreted as a tacit waiver of these rights, which they can exercise at any time.

 

Exhibit A – Company Rules, regarding Placement, Conduct and Security.
Hr-tourism is the only party that has jurisdiction to interpret these Rules. Hr-tourism may in its sole discretion suspend and terminate the use of the Website of those Users who violate the Rules. Hr-tourism has the right to modify the rules from time to time.

A’1. Document Placement Rules.
(a) Your Document may not contain:
(i) URLs or referrals to other websites (to advertise your company or your Website, see the page related to the advertising information),
(ii) Material that constitutes protected copyright (except that you are the owner of these rights or have obtained permission from the owner to use and post the protected material on the Website),
(iii) trade secrets (except that you are the owner of these rights or have obtained permission from the owner to use and post them on the Website),
(iv) material that infringes any other copyright or infringes the personal data or publicity rights of others;
(v) anything that is pornographic, obscene, false, defamatory, threatening, disturbing, inaccurate, offensive, violent, sexually explicit, vulgar, defamatory, harassing or abusive; or
(vi) anything that is ridiculous or offensive to another natural or legal person.
(b) You may not use your Documents
(i) to impersonate another person whether that person is alive or dead;
(ii) post false, inaccurate or misleading information on the Website;
(iii) place advertisements and professional suggestions (,),
(iv) place chain letters;
(v) post opinions or announcements, whether commercial or otherwise.
(c) Your Document must contain sufficient details to communicate to the User clearly the nature of the job, your specifications and qualifications as a job seeker. Documents that encourage the User to send emails with more information are not allowed. Documents from any third party that charges a fee or restricts access to certain CVs are prohibited.
(d) The placement of a CV must contain the exact copy of the CV of a person seeking part-time or full-time employment.
(e) Hr-tourism has no responsibility or obligation to check the Documents which are published and placed on the Website, but may conduct random random sampling. Documents found to violate the above rules may be removed from Hr-tourism, at its discretion.

A’2. Management Rules
(a) You may not reply to and respond to posts for any reason or in any manner other than that provided (to apply for a job or to engage in further dialogue with a prospective employee). Communication from our competitors in order to motivate employees of the employer’s company is not allowed.
(b) You are not allowed to send junk emails to Users
(c) Protect your password. You are responsible for keeping your password and information confidential. You are also responsible for all uses that may be made of your writing, whether or not they have been authorized by you. If others use your password to post and publish inappropriate material, you run the risk of having your license revoked. You agree to inform Hr-tourism of any unauthorized use of your registration and password.
(d) Report any inappropriate posts or behavior to Feedback
(e) You do not have the right to delete and correct material that has been posted and published by another natural or legal person.
(f) If during the duration of the Contract Hr-tourism creates the opinion that
(i) You have misled Hr-tourism about your business practices and / or services,
(ii) If you have provided services that do not represent your business, then Hr-tourism reserves the right to terminate this Agreement.
(g) Hr-tourism is not obliged to control the behavior of its Users, but may investigate and respond to complaints of violations.

A3. Safety rules

(a) Users are prohibited from violating or attempting to violate the security of the Website, as indicative, but not restrictive:
(i) access data that is not intended for a User or connect to a server or account that you do not have access to as a User;
(ii) attempts to investigate or test vulnerabilities in the system or network or to violate security or certification measures without authorization;
(iii) attempts to disrupt the service to any User (…),
(iv) send unsolicited emails, including promotional promotions and / or advertisements of products or services
(v) falsify any information (…). Violations of the system or network security may result in civil or criminal liability.
(b) Violation of these Safety Rules may result in civil or criminal prosecution. Hr-tourism will investigate incidents that may be related to such violations and may engage and cooperate with police authorities in prosecuting Users associated with such violations.
